ARBITRARY PROPERTIES – PLOT RATIO

The new bill of the Ministry of Environment and Energy entitled “Regulations to address the multilevel effects of climate change in the areas of: a) water management, b) forest management and protection, c) urban resilience and policy, d) the fight against arbitrary construction, e) energy security” brings significant changes. These include modifications to the settlement demarcations, the buildability in areas that are out of city plan, the way the state deals with arbitrary buildings, the plot ratio, as well as some building permits that are to be extended.

The hitherto applicable General Urban Plans and the Open City Spatial Housing Organization Plans will be replaced by the Local and Special Urban Plans (LSUPs) to make it easier to settle real estate and manage the boundaries of residential or non-residential areas. The main purpose of the bill is to fight arbitrary construction for which rapid measures are required to be taken. This is to be achieved by installing new technology control mechanisms (AI, drones, etc.) to identify and record arbitrary buildings and by creating specialized teams responsible for the demolition of them.

At the same time, the New Building Code (NBC), aiming at the general improvement of the urban environment, requires the reduction of the additional building height in new buildings and at the same time focuses on improving their energy efficiency. Specifically, the building “bonuses” is expected at the end of 2025 to not exceed 3 meters, and only if certain conditions are met regarding the living standards offered by the infrastructure of the new building.

The plot ratio of each area also seems to affect the final height that the new buildings will be allowed to have as the bonus will be determined based on it. More specifically, in areas where the plot ratio is greater than 1.6, the maximum additional construction (3 meters) can be achieved and as long as the ratio decreases, the possibility of legally exceeding it will be reduced accordingly (for a ratio of 0.8 to 1.6 it will be up to 2.5 meters and for areas with a ratio less than 0.8 it will be up to 2 meters).
